Legal notice

PURPOSE, OWNERSHIP AND ACCESS.

The purpose of FOLERPA is to provide, in a single website:

An interactive platform that allows distributing auditory perception tests, distributing the tests to experimental subjects, obtaining responses, and managing tests already created. Two access profiles are available: researcher users, who can access a private workspace where they can create perceptual tests, manage tests they have already created, distribute tests among participants and download responses obtained; and participant users, who can directly access and respond to the experimental tests proposed by researchers.

FOLERPA is an application program property of the University of Santiago de Compostela, the Galician Language Institute (Instituto da Lingua Galega) and the FILGA Research Group (GI-1743), protected by intellectual property rights (Article 95 et seq. of the Intellectual Property Law).

Findings derived from tests that are developed using FOLERPA are property of the researchers in charge of carrying out said tests.

Users may perform any actions necessary to access the application, create, or respond to perceptual tests. However, users may not:

  1. Perform any actions that conflict with the normal exploitation of the platform or might unreasonably prejudice the legitimate interests of the rightsholder.
  2. Upload audio files that a user has not obtained permission to use, nor access other users' perceptual tests without prior permission.
  3. Distribute copies of the application's code without license from the owner of said application
  4. Use the application for commercial purposes
  5. Use any instruments or technical devices that might remove or \disable the protection of the computer system
  6. Carry out any other acts that are prohibited by Intellectual Property law (Royal Legislative \Decree 1/1996 dated April 12).

The owner's license is not required:

  1. If the platform is used for private purposes.
  2. If the platform is used for the purposes of illustration in teaching or scientific research, provided that the source is mentioned. Users must cite FOLERPA as the tool used for carrying out perceptual tests and collecting data, according to the citation model provided on the application homepage.   3. If the platform is used for purposes of public security or for the purposes of administrative or judicial procedures.

Access to certain services (creation of perceptual tests, administration of perceptual tests, download of data obtained, and participation in perceptual tests) is conditioned by prior user registration. During the registration process, users must provide truthful and accurate information. Likewise, users agree to keep their password personal, non-transferable, and confidential

FOLERPA reserves the right to deny access to any users who fail to comply with the legal provisions and terms of use contained in this Legal Notice. Likewise, FOLERPA reserves the right to take appropriate legal actions to defend its rights.

OTHER RIGHTS

The intellectual property rights to the contents of the website, the software used (source code included), graphic design, and the different elements that make up the website (logotypes, contents, and images), are the property of the USC, their total or partial reproduction being prohibited without licence from their rightful owner

DATA PROTECTION

To access certain services offered by FOLERPA (creation of perceptual tests, administration of perceptual tests, download of data obtained, and participation in perceptual tests), users must sign in to the platform. Personal data collected to that effect shall be processed according to the provisions of the Organic Law on Protection of Personal Data and the EU General Data Protection Regulation.

In accordance with the EU Regulation 2016/679, data obtained shall be processed by the University of Santiago de Compostela (USC) with the purpose of granting access to the services offered by this application.

Such data is collected and stored in the database labeled "users of USC services", with the purpose of managing information on natural persons who receive or benefit from non-academic services offered by the University of Santiago.

The data controller is the Vice Rectorate for Communication, Culture and Social Responsibility, located at Colexio de San Xerome, Praza do Obradoiro s/n, 15782 Santiago de Compostela.

The Data Protection Officer is Julio Fernández Rodríguez, who can be contacted at dpd@usc.gal.

Personal data is processed on the basis of the explicit consent of the data subjects by means of the explicit acceptance of this legal notice and the data protection policy herein stated.

Data stored in this database will not be transferred to third parties. Access to and processing of the information regarding tests and users (both participants and researchers) will be limited to the sole purpose of improving application performance or creating usage statistics.

Interested parties can exercise their rights to access their data, to request the rectification or erasure of data, to request the restriction or data portability, or to object to the processing of their data by accessing the USC Electronic Office: https://sede.usc.es/sede/publica/catalogo/procedemento/55/ver.htm

Interested parties can also submit any claim or request to the Spanish Data Protection Agency.

Any services that require prior identification or authentication will not be accessible without acceptance of this data policy.

Data shall be kept for the time necessary to achieve the purpose of its collection or as long as it is required to comply with legal obligations.

After having served its purpose, the data will be blocked until the end of the applicable statutory period, except when such data should be necessary to provide the public service of higher education.

EXCLUSION OF LIABILITY

Access to this web page, as any use that can be made of the information contained therein, is the sole responsibility of users.

The owner is not liable for the content or rights to use the files uploaded to the platform by users, nor for any experimental subjects' data collected by users.

The owner is not liable for any loss, damage or liability that can be suffered by users' computer equipment as a direct or indirect consequence of accessing this website.

Likewise, the USC is not liable for any consequence derived from any malfunction of the webpage that may be derived from exceptional circumstances, force majeure, necessary maintenance work, or any other cause, nor for any errors or inaccuracies on this website.

With the purpose of offering users more information and making available a wider range of resources, FOLERPA includes links to third party websites. Such websites are not under the control of FOLERPA, nor is FOLERPA responsible for their access connection status, contents, or terms or use. Users who access any of such links do so at their own risk and under the terms and conditions of each of these resources.
